Terms of Service

These Terms of Service ("Terms") govern your access to and use of AI Centery (the "Service"), an AI website builder. In these Terms, "we", "us", and "our" refer to AI Centery, the provider of the Service. By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

AI Centery lets you generate, edit, host, and publish websites and related content using artificial intelligence. We may add, change, or remove features at any time. We may also impose usage limits on AI generations, storage, or other resources.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and auto-renewal

  • Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe.
  • Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel.
  • You authorize us to charge your payment method for all fees due. Taxes may apply.
  • You can cancel at any time. Cancellation, refunds, and what happens to your sites on cancellation are described in our Refund and Cancellation Policy.
  • If a payment fails, we may suspend or downgrade your account until the amount due is paid.

4. Free trials and credits

We may offer free trials or promotional credits. Unless stated otherwise, trials convert to a paid subscription when they end, and credits have no cash value and may expire. We may change or withdraw trial and credit offers at any time.

5. Your content and published sites

You retain ownership of the text, images, logos, and other materials you provide or publish using the Service ("Your Content"). You grant us a license to host, process, reproduce, and display Your Content solely to operate and improve the Service.

You are solely responsible for Your Content and for the websites you publish, including their legality, accuracy, and compliance with applicable laws (for example consumer, advertising, privacy, and intellectual property laws). You represent that you have the rights needed to use and publish Your Content.

6. Acceptable use

You agree not to use the Service, and not to publish content, that:

  • is unlawful, infringing, defamatory, fraudulent, or deceptive;
  • contains malware, or attempts to disrupt, probe, or gain unauthorized access to the Service or its infrastructure;
  • harvests data unlawfully, sends spam, or violates the privacy or rights of others;
  • promotes hate, violence, or sexual exploitation, or is otherwise harmful or abusive;
  • misuses AI features to generate prohibited, infringing, or misleading material; or
  • resells or sublicenses the Service except as expressly permitted.

We may investigate suspected violations and may remove content or suspend accounts that breach these Terms.

7. AI-generated output

The Service uses third-party AI models to produce text and images. AI output can be inaccurate, incomplete, or unintended, and may resemble other works. You are responsible for reviewing AI output before relying on or publishing it. We make no warranty that AI output is accurate, original, or fit for a particular purpose.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by AI Centery and its licensors and is protected by law. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service.

9. Third-party services

The Service relies on third parties (for example payment, email, telephony, hosting, analytics, and AI providers). Your use of those features may be subject to the third party's own terms. We are not responsible for third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, AI Centery will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless AI Centery from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your published sites, or your breach of these Terms.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends and we may delete your data after a reasonable period, subject to our Privacy Policy and the Refund and Cancellation Policy.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example by email or in the Service). Your continued use after the changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in the State of Delaware, United States will have exclusive jurisdiction over any dispute, unless applicable law requires otherwise.
